PACO GOMEZ NADAL'S MESSAGE TO HIS ARRIVAL IN MADRID TELLS HIS VERSION

From San José de Costa Rica, en route to Madrid (Spain)

I have been expelled from Panama in today by the government of Ricardo Martinelli. The statutory formula is called voluntary return but it is neither voluntary nor return. Explain the circumstances:

1. On Saturday 26 February I was illegally arrested when clearly identified as a member of the human rights organization Human Rights Everywhere (HREV), documented the eviction of indigenous people who cut the Plaza Ngäbe May 5. The arrest with violence and without any contemplation. In the operation was also detained arbitrarily and illegally my partner, Pilar Chato, who was on the platform at the corner of May 5th and L Street waiting for the end of events.

2. In the next 20 hours were held at three different institutions and at no time told us what we charged, we are not allowed to communicate with our lawyers and consular assistance from the Embassy of Spain, a country of which we are citizens. Officials themselves Ancon DIJ told us that there was no record or documentation justify our detention in these facilities (where we had to sleep on the floor on newspapers)

3. That in the afternoon of February 27, 1923 hours after the arrest, were victims of a trial in the Corregedoria express Balboa with false accusations of the National Police (as it was not identified at the time of detendicón or that read us our rights or we were informed of the reasons for the act) and based on a video without audio, obviously, is not evidence of any criminal offense or violate Panamanian law.

4. That approximately 4:30 pm we were taken to the offices of the National Immigration Service where not even know why they received so as we said, "got a call from Presidency." Once we received as "retained", SNM officials assured the consul of Spain, our lawyer and representatives of the Ombudsman's Office that no steps would be made until the morning of February 28 and for that reason should remain in the cell migration, despite the commitment of national and international staff to serve as guarantors of our appearance the next day.

5. That after leaving the support team, the director of the SNM with her lawyers issued a decree illegal and arbitrary that we condemn without trial detention for disturbing public order and to "instigate" protests. "We were woken up after midnight , intimidated and disrespected and forced to sign a document stating that the NWS had heard our defense and our human rights respected, when this had occurred.

6. That to the arbitrary actions, the aggressiveness of the public announcements Government from the Saturday 27 and the background of the attempted expulsion of July 4, 2010 and at the total lack of legal guarantees for a fair process for our safety or physical or legal, we decided to accept voluntary deportation.

7. Manfestamos the absolute lack of guarantees for the work as Human Rights Defenders in Panama and alerted UN and Human Rights Commission Interamerciana of the serious risk that other defenders are under any leader in Panama and social.

8. We will exhaust all legal remedies available in Panama and the American system of justice to reverse this situation and demand compensation for moral damages and personal development we have been subjected to abandon our home, our friends, our mission as advocates for Human Rights and our professional development.

9. HREV and myself have only tried to promote and defend the human rights of Panama's most disadvantaged groups, as is our mandate. Our reports on human rights violation in Changuinola or Tocumen Compliance Center or our track the whole process of territorial defense of the Naso people, and Bugle Ngäbe have angered the authorities have desconodio the recommendations of international organizations regarding human rights of these populations. This situation is compounded by my work as a journalist and columnist for the newspaper La Prensa with critical work makes the government uncomfortable as we have stated on several occasions.

10. The treatment of lower-ranking officials of the DIJ and Migration was always right and they showed their puzzled ourselves to this process.

11. The indigenous people of Panama need not instigators. They are autonomous and dignified, and when they protest are often caused by government measures, apart from the secular abandonment, adopted measures affecting the autonomy territorial, cultural and political life of indigenous peoples.

12. We recognize and deeply appreciate the bravery, courage and solidarity that many organizations, citizens and, in particular, representatives of the indigenous peoples of Panama we have shown in recent hours.

We check Panama. We check their government.

The struggle for human rights is inalienable and indefeasible crimes against humanity.
